A reading in the Kuwaiti Family Court Law
Family Court Law No. 12/2015
The Kuwaiti Family Law was issued on 3/11/2015, which contains 17 articles that will remove the obstacles and obstacles that hinder the Kuwaiti woman's path in the matter of her legal and financial rights.
As the law stipulated the establishment of a family court in every governorate that includes all the bodies concerned with it, such as the Family Prosecution Department, and the Administration for Execution of Judgments ... In addition to the establishment of a center in each governorate that is in charge of settling family disputes through friendly solutions to settle those disputes of all kinds in complete secrecy, this is in addition to A special department for the implementation of judgments and orders issued under this law, and it is subordinate to the General Administration for Execution.
The law has been keen to guarantee freedom and protection for all the rights of Kuwaiti society, citizens and residents, regardless of nationality, religion or sect, in a way that strengthens the bonds of mercy and love between the homeland.
The most important of what is stated in the text of this law is that it canceled in Article Thirteenth the appeal by way of cassation in judgments and orders issued in personal status matters by the appeals departments of the Family Court.
However, the law permits the Public Prosecutor to make an exception from the family to appeal by cassation the provisions that affect the provisions of Islamic law related to public order.
The law created the jurisdiction of the temporary matters judge in the Family Court ... and he is the one who is delegated to do so by its judges to issue an order on a petition in important matters, for example .. the entitlement to the endowment of the dowry, temporary alimony, the waiting period, the fun, disputes of seeing the child, permission to travel outside the country and permission to obtain and renew a passport And his extradition ... as well as registering the child in government schools or private schools, and the order is issued according to the procedures stipulated in Article 163 pleadings (related to orders on petitions) and the grievance is in accordance with Article 164 of the same law, except for permission to obtain passports, birth certificates and civil cards for the child, the grievance is before the Civil Department.
In order to preserve the rights of women, the Family Court Law established the Family Insurance Fund ... to implement the judgments and decisions issued by the Family Court with an alimony report for the wife, divorced woman, children, or relatives, which cannot be implemented according to the procedures established for the implementation of judgments.
There is no doubt that the issuance of this law contributes to family stability and to shorten the degrees of litigation so that it ends upon appeal, in addition to the introduction of orders on petitions in specific matters in personal status, as indicated above, in a way that contributes to achieving prompt justice, which was an urgent requirement for the Kuwaiti family and the entire Kuwaiti community. The law is a civilizational shift for Kuwait in light of its interest in the family, which is the basis of society.
