Drop custody in the Kuwaiti Personal Status Law.
Article 189 of the Personal Status Law No. 51 of 1984 states: -
A- The right to custody for the mother, then to blame her even if it is higher, then to the aunt, then the maternal aunt, then the mother's aunt, then the grandmother's father, then the father, then the sister, then the aunt, then the father's aunt, then the father's aunt, then the brother's daughter, then the sister's daughter Introducing the brother, then lam, then lap in everyone.
B - If there is no person entitled to custody of these, then the right to custody is transferred to the chosen guardian, then the brother, then the neurotic grandfather, then the uterine grandfather, then the nephew, then the uncle, then his son, by presenting the brother, then the mother, then the father, whenever possible that.
C- If the persons entitled to custody are equal, he shall choose the most fittest of them for the child.
Article 190 of the same law states: -
A- It is stipulated for the person entitled to custody: puberty, reason and honesty, and the ability to raise the child, and maintain his health and morals.
B - It is a condition of the incubator that he be a female mahram, and he has a woman fit for custody.
Article 193 of the same law states: -
The right of custody is not extinguished by dropping, but rather is abstained with its impediments, and it returns with its demise.
Article 194 of the same law states: -
The custody of women ends with the boy at puberty, and for the female with her marriage, and the husband's entry with her.
Hence, custody is legally your right when you fulfill the conditions of custody - and your custody of your daughter will not end except with her marriage and the husband’s entry with her - and the judgment of the court of first degree in the appeal refusing to drop custody of you will be upheld.
