Article 24 of the Procedure Law is the jurisdiction of the court to file a lawsuit against a person who is outside Kuwait
Kuwaiti courts shall have jurisdiction over cases brought against a foreigner who has no home or residence in Kuwait, in the following cases.
If he has a chosen residence in Kuwait.
- If the lawsuit is related to a real estate or movable property located in Kuwait, or it is related to an obligation that originated or was executed or was required to be executed therein, or it was related to bankruptcy for months there.
- If the case is an opposition to a marriage contract and the contract was intended to be concluded with a Kuwaiti notary.
- If the case is related to the request to annul the marriage, divorce or separation and it was filed by the wife who has a residence in Kuwait against her husband who had a residence there when the husband has abandoned his wife and made his residence abroad after the cause of the annulment or
- If the case is related to a request for maintenance for the mother or for the wife when they have a residence in Kuwait or for the young person residing there.
- If the lawsuit is related to a matter of minor proportions residing in Kuwait, or the deprivation of guardianship over himself, limiting it, stopping it, or restoring it.
- If the lawsuit is related to a personal status issue and the plaintiff is Kuwaiti or foreign with a residence in Kuwait, and that is if the defendant does not have a known residence abroad, or if Kuwaiti law is applicable in the case.
- If the lawsuit is related to one of the issues of guardianship over money, when the minor or the person sought to be confined to has a residence or place of residence in Kuwait or if the last residence or place of residence of the absent was in it.
- If one of the litigants with him is a Kuwaiti, or a foreigner, who has a residence, place of residence, or a chosen residence in Kuwait.
