Article 61 penalties stipulate that:

2- There is a need to permit the means with which it is defended.
3 - That the assault is continuous, so that you defend yourself at the time of the attack.
Because after the end of the assault, it is not permissible to attack the aggressor under the pretext of legitimate defense - rather, it is considered aggression - there is no place for legitimate defense after the perpetrator's escape.
